The National Land Commission has been ordered by the Court of Appeal to make final submissions in a wind power project in Lamu County. The Land Commission together with a private investor (Kenwind) are involved in case with a second firm, Cordisons International. This was as a result of Cordisons International being barred by a High Court against wind power production. It was barred because it applied for land lease approvals from the county government instead of the Land Commission.
This was faulted by Justice JO Olola, who identified that under the constitution, only NLC has the legal power to lease public land to private developers.
