KANU is seeking to have a case in which it has been sued by a Nairobi businessman for failing to complete a Sh 100 million land sale dismissed. Through lawyer Titus Otieno Koceyo, the party termed the suit filed by Peter Karanja, the Managing Director of Bestlady Cosmetics Shop Ltd, as ‘premature’ and ‘incurably incompetent’.
the lawyer said the contract for the sale of the piece of land in Nanyuki Town, Laikipia County, is still on course. He accused the trader of abusing the court process and urged the court to find who between the Mr Karanja and Jaby is frustrating or in breach of the sale agreement.
Mr Karanja said in court documents that the agreement for the sale was not executed due to wrangling between the party chairman and secretary, consequently, he wanted to opt out out and let them sort out their differences without tying his money. He had paid Sh 10 million.
Documents filed in the High Court in Nyeri indicate that the sale agreement was certified and signed by KANU Chairman Gideon Moi and Secretary-General Nick Salat on October 14, 2017, before lawyer S. K. Kiplagat, 12 days after Mr Karanja offered to pay Sh 100 million for the land.
The case will be heard on November 14 at the High Court in Nyeri.
